Critically assess the Pr - Essay Example For this reason, the acts and laws passed in parliament become the constitution, as long as they have respect to the sovereignty of parliament as well as the principles of governance and legislation. The parliament in this case is sovereign and superior to every other institution in Britain, which means that it has the mandate of interpreting the constitution, thereby representing the sovereign will of the people. The un-codified British constitution constitutes values and political ideas that are based on ideals and precepts rather than fundamentals that are based on texts or documents (Williams, 1998: p 57). This means that the constitution and laws are symbols of the embodiment of their political culture, traditions and values of the British society. One of the strengths of the un-codified British constitution is that it is flexible. Many countries with the codified constitution find it difficult to pass legislation since the government is accountable and the constitution is prote cts individuals. For instance, Britain was able to pass legislation meant to detain terror suspects for a long period after several terrorist attacks. Other countries with the codified constitution during this period found it difficult to do the same since their constitutions were protecting the liberties of individuals (Watts, 2007: p 204). For this reason, these governments were not able to detain the terror suspects for a long duration, as the relevant authorities continued with their investigations. Apart from the flexibility of the un-codified constitution, its other strength is that it is able to evolve. Individuals in society live according to the changes in the political climate. This gives the British parliament the power to change some of the laws that seem to be outdated, consequently changing the way people live in the society (Watts, 2007: p 202). The ability of the evolution of the un-codified constitution creates an environment that is comfortable for individuals to r eside. For instance, in 1867, sovereignty was given to parliament, after it was taken away from the monarchy, which was responsible for the creation of a democratic political environment. This change made it possible for individuals to know their place in society. On the other hand, other than the opposition in parliament, there are no provisions for checking the government. This is one of the major shortcomings of the un-codified constitution. The absence of the checks and balance mechanisms might lead to the creation of an unjust political system, where the government might be in a position to oppress individuals in the society selectively. Using the previous example on terrorism, the British government had the capability of holding suspects for long periods, and with the probability that they might be lacking enough evidence to charge them, the detainment would be an infringement on the rights of the individual. Contrary to this, the codified constitution presents an opportunity for the creation of a political system that is just (Williams, 1998: p 52). In this case, the government will not be able to oppress individuals in the society, unless they have concrete evidence that a suspect is a terrorist. Before charging the suspect, he or she will be able to continue enjoying some of the rights and freedoms in society.

This feeling ultimately led me to the career choice of nursing and continues the path of higher education in the profession. . Nursing is more than treating an illness, rather it is focused on delivering quality patient care that is individualized to the needs of each patient. As nurses we protect, promote and encourage others to optimize their health abilities, prevention of illness, alleviate suffering and advocate in caring for the individual, their families and the community. Fruechting (2010) states, every discipline has its philosophical foundations and nursing is no different. The purpose of a philosophy is to answer the questions of what nursing is, why does it exist and what ethics and values underpin these beliefs. Fruechting continues to say that nursing philosophy, like any other disciplines-specific philosophy, is what directs and drives research and knowledge development to advance the discipline. My philosophy of nursing incorporates the knowledge of medicine, the importance of prevention and the promotion of wellness, while combining it with relational, compassionate caring that respects the dignity of each patient, their families and community. I believe nursing care should be holistic while honoring patient families and communityââ¬â¢s values. A crucial aspect of nursing is interprofessional relationships, collaborative efforts among healthcare professionals promoting quality patient care, and making health care easily accessible. A refl ection of my philosophy of nursing and the pursuit of higher education. I look at the theories and have not identified any one at this point to ground me and my philosophy, and what learning strategies appeal to me. The model has interrelated concepts of health and nursing problems, as well as problem-solving, which is an activity inherently logical in nature. Abdellahs theory identifies ten steps to identify the patients problem and 11 nursing skills used to develop a treatment typology. Abdellah describes health as a state mutually exclusive of illness. The History and Future of Computers and the Internet The early history of mechanical computers really began to take off in the mid 1940ââ¬â¢s. Between 1943-1946 the first true general purpose electronic computer was made. Constructed at the University of Pennsylvania the computer was named the ENIAC (electronic numerical integrator and computer.) The ENIAC was developed by two important keystone species, John William Mauchly and J. Presper Eckert Jr. The ENIAC was absolutely humongous; it stood 10 feet tall and occupied 1,000 square feet of floor space. On top of that it weighed in at 30 tons! The major problem with the ENIAC was its reliability. The ENIAC ran on vacuum tubes, and these vacuum tubes constantly burnt out causing people to replace them on an average of 50 times a day. Both Mauchly and Eckert realized that the ENIAC needed major improvement and began working on other designs. Unfortunately due to several members abandoning the project to pursue other jobs their next computer, the EDVAC never really took off. The first commercially successful computer to hit the market was in 1951. The computer was named the UNIVAC. The UNIVAC was manufactured by Remington Rand and was influenced by Eckert and Mauchly. The Univac was 943 cubic feet and ran on serial vacuum tubes. 46 UNIVACââ¬â¢s were built for government and business uses. The UNIVAC was able to show its superiority over other technological advances like the IBM punch card. Although the UNIVAC was much faster than the punch card it took a year for people to fully accept the UNIVAC. The UNIVAC is also known for predicting the Eisenhower election, thus making it a household name. With the UNIVAC gaining popularity some people began thinking that the computer was the next step towards a better technological future. Tom Watson Jr. was one of the few that saw a great future in computers. After struggling to convince his father that the computer was the next step in business Watson Jr. began development on the IBM 650. While the IBM 650 wasnââ¬â¢t technologically better than the UNIVAC it did sell better. Criminal Justice Ethics
After reviewing the tutorial on criminal justice ethics, my answer on the case would have to be Report the incident to your supervisor. I choose this answer for the following reasons: 1. Partner did not use prudence when making the decision to interview the minors alone, with no parental contact and choosing not to videotape the interview/confession. Ethical decisions were not made while conducting the interview. 2. Honesty and justice for the teens were not being considered in the decision of my partner. 3.Ã My job as a criminal investigator is to protect the community, respect the rights of others and serve justice to the victims. When the investigator decided to take actions into his own hands and interview the minors with no parent or guardian present and no video for evidence it not only jeopardized the case, the department as well as the community. Although the minors do have a criminal history they have the right to be treated fair and by the laws set in place to protect them until proven guilty by a judge. These rights were taken from them when the investigator did not follow department policies. Although it may be clear that these teens were guilty of this crime it is now going to be very hard to prosecute them in court because the other investigator has broken rules and been dishonest. Since it is not mandatory for the parents to be present the investigator should have at least made sure to record the interview, insuring there was enough evidence to stand up in court. If there is not enough evidence when this trial goes to court it the case may be thrown out. I now feel like it is my duty to report my partner actions to the supervisor so there will at least be record of the incident should it be brought up in the future. This will protect me as well as the department should any circumstances come up as a result of his actions. My main goal is to make sure that if these teens are guilty they are not released back into the community where they may harm others. There are rules set in place within the department to prevent these situations from occurring for this very reason. In conclusion I feel that making the choice to Report the incident to my supervisor is the most beneficial to everyone involved. The victim should have some closure and sense of security knowing these criminals are off the streets. The teen suspects are now in custody and given the rights they deserve as well as possible after the poor judgment of the other investigator. We have two potentially violent criminals off the streets and out of the community preventing them from harming more innocent people. Last we have record of the incident to help protect both investigators and the department if needed.

Cross-Cultural Perspective: The Cultural and Ethical Issue of Globalization Many American companies that are outsourcing jobs to other countries create a problem in the economy of the Unites States and also creates a cultural effect in a global scale. To this day, The United States had lost millions of manufacturing jobs compared to two decades ago (Heffner, 2012). Americans can no longer compete to international manufacturers, which put the United States economy in doom.There are many factors involved as to why American companiesââ¬â¢ decides to do its manufacturing business outside of the United States. The most obvious reason is the cost of labor. International wages from third world countries cost way less than wages in the United States. For example, manufacturers in China get paid 33 cents an hour (Heffner, 2012). As a company, the cost of doing business outside of the Unites States is way cheaper than hiring workers in the United States, which would cost more than 20 folds. In addition to wages, outsourcing jobs outside of the United States would also save companies cost for payroll taxes, benefits, and dealing with unions that are common in The United States. Moreover, doing business outside the United States increases a companyââ¬â¢s capital because the cost of labor wages and manufacturing are less, yet the sales remain the same. The cost of real estate and plant cost is less than in the United States. Companies donââ¬â¢t have to worry about maintenance, property taxes, insurance, and cost for operations (Samuels, 2013).Although there are standards created by the International Labor Organizations when it comes to doing business in other countries, there are still fewer regulations set forth in other countries compared to regulations that are mandatory in doing business in the United States (Samuels, 2013). Companies will need to follow set rules and regulations in the United States, which means more paperwork, more taxes, worrying about worker s rights, providing benefits to workers, paid time offs, vacations, etc.More regulations means more cost and companies will definitely outsource jobs outside of the United States if it means saving them millions of dollars in cost. Another effects of outsourcing jobs outside of the United States are the cultural changes that are accompanied by doing business in other countries. It is no doubt that economy of third world countries are growing due to international trade that most foreign company brings in. But global business can change the way people live in a country. The ways of living are affected and so as the native language of the country.For example, The Philippines is considered one of the poorest countries in the world (The Poorest Countries in the World, 2013) and just a decade ago there were very few foreign countries that do businesses in the Philippines. Now, there are so many American companies like, IBM, Cisco, TeleTech, and Sprint that outsourced jobs to the Philippin es. Again, it is good for the growing economy of the Philippines, but at the same time it creates a culture shock in the country. It is now mandatory to take English courses in the Philippines, and most people are now speaking English language.Long-term effect could be a decline in the native cultures in the Philippines. One example of ethical problems that arises in global business can be seen in the case of the company Nike. More than a decade ago Nike was involved in a scandal that the company allegedly hired children in its workforce in Pakistan, but later it was concluded that it was indeed the truth. Children made the soccer balls that were manufactured in Pakistan by Nike Corporation. It was known that the children were paid 66 cents to spend all day stitching the soccer balls.Although there were laws in Pakistan about child labor, it was not fully enforced in the country (Azam, 1999). The problem was that records of birth were nearly impossible to obtain in countries like Pa kistan. Therefore, there are now records keeping of how old the workers were. The country is not like the United States was every born child is listed in a database. Nike Corporation admitted the allegations and apologized for employing workers that in the United States would be considered under aged workers (Boggan, 2001) .The company pledged not to hire under aged workers, ââ¬Å"Nike said it would raise the minimum age for hiring workers at shoe factories to 18 and the minimum age for hiring workers at other plants to 16, in countries where it is common for 14-year-olds to hold such jobs. It will not require the dismissal of underage workers already in placeâ⬠(Cushman, 1998). The company also ââ¬Å"pledging to allow outsiders from labor and human rights groups to join the independent auditors who inspect the factories in Asia, nterviewing workers and assessing working conditionsâ⬠(Cushman, 1998). Companies like Nike needs to consider the ethical responsibilities that is part of doing business in other countries. Not just because the country, like Pakistan, has laws that were not enforced properly in the country, it does not give any company the right to stray from the ethical responsibilities of companies to their employees. They should treat workers of other countries the same way that they would do if they were to employ workers in the United States.When companies do business with other countries they must be aware of the cultural and ethical perspective that can arise in doing such businesses. There are many factors that influence the companiesââ¬â¢ decision on outsourcing jobs, but the social responsibility of a company must be equal across the board. It doesnââ¬â¢t mean that wages, benefits, or other factors will be the same for worker in the United States and in other countries, but the level of commitment to workers, respect, and treatment must be adherence to the ethical responsibilities of companies to their worker. Requisitos del acta de nacimiento para Inmigracin Si le han pedido un actaà de nacimiento o debe presentarlo durante la tramitacià ³n de una peticià ³n o solicitud migratoria para Estados Unidos, es posible que sienta inquietud porque desconoce los requisitos que debe cumplir el documento. No se preocupe, este artà culo resuelve todas las dudas. Se aclara quà © informacià ³n debe contener el acta de nacimiento para ser admitido por las autoridades migratorias. Tambià ©n si debe estar traducido y/o notarizado y quà © hacer cuando esà imposible conseguir uno. Y es que si se saben las reglas no es complicado seguir sin problemas con la tramitacià ³n que se est gestionando. Antes de empezar, comentar que un acta de nacimiento se puede llamar en algunos paà ses certificadoà o partida de nacimiento. En todo caso, es lo mismo y aquà los tres nombres se utilizan indiferentemente. Situaciones para las que se pide un acta de nacimiento Lo cierto es que pueden ser muy variadas pero por lo general tiene lugar en tres tipos de trmites: cuando un ciudadano americano debe acreditar su nacionalidad es uno de los documentos admitidos cuando se ha nacido en Estados Unidos. Asà se solicita una copia.para los trmites para obtener una visa de inmigrante (tambià ©n conocida como green card o tarjeta de residencia). Este requisito se pide tanto en los ajustes de estatus (I-485) como en los procedimientos consulares.Y, por à ºltimo, en la tramitacià ³n del I-9, para verificar que se es elegible para trabajar. Aunque puede suceder que se solicite un acta de nacimiento para trmites relacionados con las visas no inmigrantes, estos casos no son frecuentes. Requisitos del acta de nacimiento extranjero para Inmigracià ³n Es frecuente que las autoridades migratorias o consulares soliciten un acta de nacimiento a personas extranjeras como parte de la tramitacià ³n de peticiones o solicitudes. En estos casos, esà preciso presentar una copia del certificado emitido por otro paà s que debe incluir todos los siguientes requisitos: Nombre y apellidos completos, sin incluir inicialesFecha y lugar de nacimientoNombre de los padresSello de la autoridad que emite el documento como, por ejemplo, el Registro CivilAnotacià ³n de la autoridad que lo emite en el que se especifica que es una copia del original No se admite un acta de nacimiento emitido por el consulado o la embajada de un paà s en los Estados Unidos. à ¿Tiene que estar notarizado? Para casos relacionados con la obtencià ³n de la tarjeta de residencia (green card) el certificado de nacimiento no tiene que estar notarizado, ni certificado ni apostillado.à Adems, no es necesario el original, basta con una simple copia (el sello y la firma tienen que ser orginales). Para otro tipo de trmites, seguir fielmente las instrucciones sobre requerimientos, ya que pueden ser diferentes. à ¿Tiene que estar traducido al inglà ©s? Por à ºltimo, si el documento no est en inglà ©s hay que traducirlo. No es necesario que la traduccià ³n la realice un traductor certificado. Basta que la realice una persona con buenos conocimientos del inglà ©s y del espaà ±ol y que asà lo afirme y se identifique en una declaracià ³n jurada (affidavit). Se puede seguir este modelo de carta. Lo que sà es imprescindible es que dicha traduccià ³n la realice una persona distinta al beneficiario de la peticià ³n migratoria. Tampoco puede realizarla el patrocinador de unaà green card. à ¿Quà © hacer cuando no hay acta de nacimiento o contiene errores? En casos muy concretos y extraordinarios no ser posible presentar el acta de nacimiento porque o bien nunca existià ³ o bien los archivos en los que se encontraba se han destruido o no es posible encontrar la anotacià ³n original. Incluso porque el registro del nacimiento no se realizà ³ durante el primer aà ±o de vida. Cuando asà suceda las autoridades de inmigracià ³n permiten presentar documentacià ³n secundaria para probar el nacimiento. En primer lugar, hay que dirigirse al Registro Civil o a la oficina oficial que en la actualidad lleve este asunto en el lugar donde la persona nacià ³ y solicitar que se emita un certificado de falta de registro en el que se seà ±ale claramente que se ha buscado la documentacià ³n solicitada y que no se ha encontrado. Y a continuacià ³n se puede acompaà ±ar tal certificado de falta de registro con evidencias adicionales, siendo la preferida una declaracià ³n jurada de una persona - puede ser un familiar- que hubiera tenido conocimiento directo del nacimiento. Si no es posible, pueden admitirse rà ©cords como el de bautismo o incluso informes mà ©dicos o escolares. El Departamento de Estado publica una lista de documentos que pueden presentarse como evidencia secundaria de nacimiento y que puede cambiar de paà s a paà s, por lo que de darse el caso es recomendable consultar directamente con la oficina consular cuya jurisdiccià ³n se extienda al lugar en el que tuvo lugar en nacimiento. Informacià ³n especà fica para mexicanos en Estados Unidos Algunos estados mexicanos permiten solicitar el acta de nacimiento por internet. Estos son los pasos a seguir.
